( -- February 12, 2013) Milton Keynes, Buckinghamshire, UK -- Increasingly, UK employees are being asked to enter into employee compromise agreements as more businesses seek to manage out excess staff while at the same time circumnavigate tough UK employment laws.

As a triple-dip recession takes hold in the UK, major stores across the country are embarking on major re-organisations and restructuring to save cost across the board.

Jessops, Blockbuster and HMV are just a few of the household names to have collapsed in recent months, putting further strain on an already beleaguered employment market, leaving many more thousands of jobs at risk.

But it's not just the big corporation that are feeling the pitch. As small and medium sized employer organisations also continue to feel the pain from the fall-out of a very prolonged credit crunch, many of these busineses that have been holding out on shedding staff numbers are now coming round to the realisation that job losses are necessary.

The realisation that the UK economy is not turning around any time soon, is forcing employers to make the hard decision of reducing staff numbers.

The challenge that many smaller and medium size firms face is how to properly navigate what can be complex employment laws, regulations and procedures without falling foul and being an unwitting recipient of an employee claim for compensation for either breach of contract or employment laws and regulations.

Which is why employee compromise agreements are so prevalent today.

A Compromise Agreement, also referred to as a Settlement Agreement is a specially drafted legal agreement. It allows an employer to terminate an employee's contract of employment on mutually agreeable financial terms, regardless of the reasons for the termination, with the core condition that the employee will not be able to pursue any employment claim.

As a legally recognised and binding agreement, where an employee signs an employee compromise agreement, so long as the agreement has been properly formulated to satisfy prescribed conditions set out in section 203 of the Employment Rights Act 1998, an employee will be prohibited from bringing any further claim for compensation in respect of their employment.

It is in effect a safety net for employers, as it allows them to safely end an employment contract without fear of a future potential employment claim by the employee.

Some employees will naturally feel suspicious and concerned if their employer hands them a lengthy legal document entitled "without prejudice subject to contract - Compromise Agreement".

In many cases however, there is nothing for employees to be concerned about and in any event employees are required to obtain the advice of a solicitor who will be able to advise and explain the implications of the agreement and in some instances negotiate a better compromise agreement settlement.

If an employee has concerns as to the legality of the proposed termination of their contract of employment, or they feel that they are not being treated fairly or not being given a fair deal, speak with a specialist employment law compromise agreement solicitor who will be able to properly advise employees of their rights and their entitlement on termination of employment.

( – February 12, 2013) Beachwood, OH -- Beachwood Plastic Surgery and Medical Spa, a leading medical company based in Ohio, headed by Board Certified Plastic Surgeon, Steven Goldman, now offers Fractora Firm. Fractora Firm is a non-surgical face-lift treatment without pain or downtime. The mission of the said company is to help both men and women customers to achieve their skin care goals without going through painful and harsh surgical procedures.

Fractora Firm entails heating the skin’s sub dermal layers to promote skin and collagen tightening, that is why it is also referred to as a thermal rejuvenation treatment. It comes available with built-in safeguards that enable accurate thermal temperatures for skin contraction without any overheating risks.

The treatment also has several benefits. It delivers enhancements in the widest range of skin aging symptoms, which include redness, blood vessels, pigment irregularities, texture, deep lines and fine lines with the use of two to four different technologies. With the use of Fractora Firm’s ACE technology, the areas of concerns of thermal-based skin tightening technologies are addressed. It also has a thermal monitoring technology, which eliminates adverse reactions such as overheating.

Experts also claim that the said skin treatment is versatile, as it can be utilized on all facial areas such as face, jowls and neck.  This is one of the factors that paved the way for its instant popularity shortly after it was launched in the market.

Recently, it has been featured in the Dr. Oz Show and got compliments from viewers.  Oz touted it as a beauty bargain, as it only costs around $300, which is more affordable than other face lifts available in the market today. However, this cost varies from one state to another.

( -- February 12, 2013) London, UK -- Janitors and office cleaners know the importance of preparing for flu season and having cleaning strategies in place for the workplaces they are responsible for cleaning. With the flu season picking up, members of the cleaning profession want to make the general public aware of the need for thorough cleaning in homes as well.

The influenza virus is of a type that mutates very rapidly, meaning that new strains develop every year, making it hard for the body to build a proper immune reaction against it without the help of the flu vaccine. Unlike other vaccines, the flu vaccine needs to be renewed each year, as each year’s flu vaccine is different from the last and has been developed by epidemiologists monitoring the genetic shifts in the virus’s DNA so that the vaccine provides protection against the current strain of the flu.

While the flu vaccine is the first line of defence against this potentially dangerous virus, the next lines of defence this season are related to good hygiene. Businesses need to make their staff aware of the need for vigilant handwashing in order to minimise time off work during the busy lead up to Christmas. Handwashing should not only be confined to just washing after using the toilet. “Toilets actually tend to be cleaner than other places around the office and most people tend to know about washing hands after going to the loo,” said a representative from the London-based cleaning company Anyclean. “But you need to wash your hands and disinfect them before eating or drinking – or doing anything that involves touching your face”

The flu virus is spread via secretions from the mouth, nose and eyes, and these orifices are also the main places where the virus enters the body. After being transferred to a surface such as a tap, a computer keyboard, a steering wheel or a telephone, the virus can remain active and capable of infecting another person for several hours. “And people don’t realise how often they touch their faces,” said the Anyclean representative. “We’ve all got grubby habits like picking our noses and we know we ought not to do them. But even rubbing your eyes or covering your mouth when you yawn could be enough to give you the flu if you’ve touched a contaminated surface.”

Cleaning using a strong disinfectant is the third line of defence against the transmission of the flu. Even if these surfaces are not cleaned frequently as part of the regular cleaning schedule, they should be added to the daily tasks during the flu season. “Door handles, desks, keyboards, mobile phones – anything that a person might touch with fingers contaminated from contact with hands and mouth,” said the Anyclean representative, listing places that need to be given particular attention by office cleaning staff. “Phones are particularly prone to picking up the virus – you hold it right up to your face and breathe all over it when you talk on the phone, after all.”

Regular cleaning is important in office spaces but should also be given attention in the home, especially if there are small children or the elderly in the home, who are more vulnerable to the flu virus.

( February 12, 2013) Tampa, FL--  With the regional furnace standards changing, it is obvious that there is more to come across the lines of HVAC.  Manufacturers are certainly wired to the impending mandates.  It seems that the ac industry must adjust their priorities as these changes occur.   Production schedules must change which can also adversely impact energy savings initiatives.  Many air conditioning companies claim that no customer service will ever be adversely affected, however the rigorous testing procedures required to go to market are never exactly predictable.  Inconsistencies in requirements for different parts of a furnace also can waylay the production times.

For HVAC companies, the impact of GWP (Global Warming Potential) are forcing them to use a more stringent refrigerant that contributes to less GWP yet will still maintain a very high efficiency.  Some companies are actually advising regulators on the cost benefit strategies towards using various new refrigerants.

As the industry looks forward, there will be  efforts to tighten the home envelope and duct configuration.  In 2012, some leading ac manufacturers began training contractors to become more knowledgeable in all aspects of home energy conservation.

In order to stem the mountain of changing regulations, those that have best adjusted have maintained close alliances with industry regulators such as: AHR ( Air-Conditioning, Heating, and Refrigeration Institute,), ACCA  ( Air Conditioning Contractors of America), and HARDI (Heating, Air Conditioning, and Refrigeration Distributors International.

AC specialists are not the only knowledgeable source of information.  Contractors and government people are a good source as well. Here information concerning tax credits is also found.  Downloadable forms for consumers can be accessed here where homeowners can submit tax credits to their IRS filings.  Knowing which tax credits are acceptable and which are not  also is key.  Soon there will be a high efficiency compression move for customers to gain greater efficiency throughout the home in a cost effective manner.

It appears that industry wide communications amongst trade associations, manufacturers, distributors, and contractors  will be imperative in order to stay abreast of what is in the air conditioning and HVAC regulatory offing.

( -- February, 12, 2013) Goodyear, AZ -- With Valentine's Day right around the corner, the demand for top quality flowers grows expotentially.  As a result, flower growers do their best to harvest the exact amount of flowers to meet the demand.  Many times, due to weather and other conditions, there simply isn't enough flowers for all the flower shops to buy for Valentine's Day.

That's why flower shops everywhere are scrambling to obtain as many flowers as they can to be ready for an onslaught of flower orders and arrangements to be purchased and delivered for Valentine's Day gifts. However, not all flowers are created equal and some are of a higher quality than others.

Thompson's Flower Shop has already secured a bountiful amount of premier roses and assorted flowers to ensure that it can provide the best flowers that will help make their arrangements maintain their beauty.  This means their floral arrangements will last longer and will give more value to the lucky recipient.  Those purchasing these floral arrangements just might be able to make Valentine's day an extended holiday.

Thompson's, a Goodyear florist, has various floral arrangements available for all budgets, from value-priced bouquets starting at $50, to 2 dozen long-stem (85-100 cm), premium red roses in a 2-ft vase with all the accessories for only $250, and everything in between.  Rather than limiting its customers to pre-defined selections on their website, Thompson's Flower Shop decided to offer complete customization for their customers.

Cynthia Thompson, "We're not trying to be a 'cookie-cutter' flower shop and force people to choose from 4 or 5 flower arrangements.  Our goals is to allow our customers to be creative and contribute to their gift. When they give their Valentine's Day gift to their loved one, they can honestly say that they helped to create it! It also allows people to buy Valentine's Day flowers at a price that fits their budgets."

Thompson's Flower Shop is currently taking orders and is offering Valentine's Day flower specials. Quantities of floral arrangements are limited, so those wanting to order flowers are encouraged to call the flower shop immediately at (623) 932-0531 before they are completely sold out.

(—February 12, 2013) Tampa, FL--   The notion of Spring cleaning is a farce when it pertains to performing the action of what it is designed to perform.  Janitorial cleaning services cannot be done cumulatively like picking berries.  It is a continual process that must be targeted regularly and administered consistently.  The things that are being cleaned cannot be done and put away until months later.  The growth of bacteria is a process that only deepens as time goes on.

Professional janitorial services know this better than anyone else.  Imagine cleaning a public toilet once every two months when there is human traffic passing through of approximately 100 people a day.  In order to do a thorough and healthy cleaning, a regular bacterial application of cleansers and germ killing solutions must be applied almost daily.  The accumulation of such dirt not only is unsightly, but it is also dangerous as germs beget germs.  Warm and moist areas are infectious for harboring such items.

When a place is administered properly with germ killing cleansers, the likelihood of any adverse development for bacteria to crop up are limited.  A good janitorial service also applies the right combination of germ killing agents as well as environmentally suitable chemicals that do not harm human health.  Although such green products are more expensive, in the long run they can save in areas that can accumulate in different ways i.e. health costs.

There are so many cleaning companies to choose from that in order to find the proper and most efficient operation, one must take the time to interview and inspect their janitorial company.  Look and see their existing work and observe how they employ their processes.

( -- February, 13  2013) Milton Keynes, Buckinghamshire, UK -- With businesses of all sizes cutting costs during these lean times, inevitably top of the target list on costs, which often represents a major share of a business's total costs, is staff costs. And with more employer's now forced to make these tough decisions with the least fuss possible, the employment compromise agreement seems to be having its day.

A Compromise Agreement is a legal document that complies with stated conditions set out in s.203 Employments Right Act 1998, and which states that the employee will not pursue any employment claims against the employer at the end of their employment. In exchange for this promise from the employee, the employer agrees a financial package on termination of the contract of employment.

The amount of the settlement or severance package that is offered, will vary significantly between employees.

Factors that have a direct bearing include such things as length of service, the age of the employee at the time of dismissal,  the seniority, rate of pay and any other contractual benefits tied to the employment. The reason for the proposed termination may also influence the eventual financial package offered.

With lump-sum severance payments equivalent to up to 6 months pay not unusual, employees may naturally be concerned to know whether this will have any adverse impact on their ability to claim Job Seekers Allowance and other benefits, especially if a prolonged period of unemployment is a real possibility.

First it needs to be understood that a financial lump-sum package can often be made up of many different components. Put simply however, these can be grouped into contractual and non-contractual payments.

Contractual payments are those payments that an employee is entitled under the contract of employment, for example, a sum in lieu of notice, unused holiday pay, car allowance and other contractual entitlements as at the date of dismissal.

Non-contractual payments are such payments made by an employer over and above what an employee is legally entitled to under his or her contract of employment, or what the law says is a minimum entitlement on termination of employment. This element of a lump-sum payment is variously described as compensation for "loss of office", "in recognition of services rendered",   "in recognition for past loyalty" and so forth.

The distinction between contractual and non-contractual payments is important from a Revenue and Benefits Office stand point.

Job Seekers Allowance (JSA) is not normally paid during the period of notice. So an employer given a payment in lieu of notice and not required to work that notice period will not be able to claim JSA in that time.

However, it would be advisable for the employee to sign on at the Job Centre in order to claim NI Contribution Credits during the notice period.

Another important criteria used by the Benefits Office to establish entitlement to benefits, is the amount of capital a person has at the date of termination of employment. There is a savings threshold of £16,000, above which a person cannot claim "income-based" JSA.

So, if an employee receives a settlement of £20,000 of which £8,000 is for contractual entitlements including a payment in lieu of notice, for the purpose of calculating capital savings, the Benefits Office usually discounts the contractual payments, which leaves in this example £12,000.

This is below the £16,000 threshold for income-based JSA, but as explained, an employee would not be able to claim JSA during their notice period.

Contribution-based JSA on the other hand is not affected by most lump sum payments and the £16,000 capital limit will not therefore apply.

Whether an employee is entitled to contribution-based JSA will depend on whether a person has contributed, during their working life, a sufficient amount of National Insurance contribution.

National insurance is deducted at source every month from an employee's salary. So for more information on this, it is advisable to contact either the Citizens Advice Bureau or your local Benefits Office.

JSA is not available to employees that leave their employment "voluntarily".

Fortunately, the Revenue and the Benefits Office do not currently interpret a Compromise Agreement dismissal as a "voluntary" occurrence. Which means that lump-sum payments packaged within an employment compromise agreement do not affect one's entitlement to claim JSA.

The rules and regulations on entitlement to benefits constantly change. Employees are therefore advised to contact their local Benefits Office or speak with a Job Centre adviser for an up-to-date position.

( - Tuesday February 12, 2013) Glasgow, UK -- Sandy Muir has only been married once and she says it's more than enough. Not because her big day last September was ruined, it went off totally fine, but because leading up to her wedding day proved to be quite stressful especially when she was buying her wedding dress.

As most brides will agree, the wedding dress is one of the most important parts of the entire day.

"Looking around all the bridal shops in Glasgow really had my head spinning. It seemed to me like the shops in Glasgow supplying wedding dresses were only after my cash", said a frustrated Sandy thinking back on her hunt for the ideal wedding gown.

A frantic and exhausting search ended for Sandy and her fiancé Tom, when someone suggested they look at the people behind the shops who supply the dresses and not the dresses themselves. With this new outlook on their search, they eventually found the perfect wedding dress in Glasgow.

"It really took a great weight off my mind when we found a shop that really looked after us. Bridal wear is a once in a lifetime purchase and I am totally lad of that", Sandy says.

In fact she feels so strongly about it she has put a website online to tell people of her experience and help them preparing for their big day.

The site tells her story, points out what to avoid and what to look out for when searching for wedding dresses in Glasgow. As part of a work project she was asked to pick a subject she feels passionate about and create the site.

"Wedding Dresses Glasgow is just a labour of love for me. I hope it saves people some of the stress that I went through and I can help them get their marriage off to a great start" Sandy remarked when asked what her aims for the site were.

For more information on the site Sandy has created simply go to and have a look around and see who she recommends. You can send her an email to

(—February 13, 2013) Duluth, MN -- Many people have cited incidents of a horrible first dental visit experience mainly because of the pain involved with treatments and procedures. This is the main reason for their fear of that dentist's chair.

From the facts gathered, Nitrous oxide gas was first discovered by scientist Joseph Priestley during 1776. It was then improved by Quincy Colton during 1840. Since then, it has been improved several times and now is used to help patients who suffer from anxiety or are very afraid during their visit with their dentists.

Many people are so terrified that they would prefer to just endure the pain instead of actually visiting a dentist and would rather persevere with it instead of going and getting the problem treated.

No doubt that dental fear is one of the problems that many dentists face. There are many people all over the world who are too scared to go for their dental check-up because of a horrible first experience. At times the thought of going through too much pain during and after the treatment can feed that fear.

A dentist’s weapon for this is the use of nitrous oxide along with anaesthesia to calm the patient down and also eliminate any pain that is associated with it.

Patients may be worried that the nitrous oxide they’re using isn’t safe or will result in side effects. Research stipulates that using or inhaling nitrous oxide is completely safe as long as it is used in the appropriate quantities. This is the main reason why you have to do some research. Experts advise to learn about the dentist you’re going to so you can ensure that they are professional and that they know what they are doing.

Nitrous oxide is also known as laughing gas and it’s expected that you will be completely relaxed and end up with a chuckle or two during your treatment. The best thing about this is that you will leave the appointment with your Duluth Dentist without feeling anything.

( -- February 13, 2013) Vancouver, BC -- Real estate is usually the least volatile investment type available. However, recent shifts in the real estate markets in Vancouver have caused some eyebrows to rise in surprise that it happened, and others to rise in surprise that it didn't happen sooner. A burgeoning surge in property values over the past decade has weakened, and prices are falling.

We recently spoke to some economic experts, financial planners, and real estate brokers about the phenomenon being experienced in Vancouver.

What has caused the fall in real estate prices that we have seen over the past 8 months?
"The basic law of gravity applies to financial markets as well. Whatever goes up will eventually come back down, and this is what is happening in Vancouver. This is also known as a market correction and it has been expected for some time now."

You can see a good price point drop in Vancouver East Houses (a second tier of Vancouver, but still with higher prices than anywhere else in the Country) here:

"Stricter rules on banks and other lending institutions isn't helping the situation either. Mortgage loans can no longer be extended beyond 25 years, and the government now only allows mortgage loan insurance on homes with a value of $1 million or less. When the mortgage boundaries get tighter, the ability to buy and sell is hampered."

Do you think that prices have bottomed out yet?

"I think we could still see another drop of around 5% before things turn around. It's just a wait and see game because so many variables are at play. Buyers seem to be waiting to see if prices will drop further, but sellers are holding out for prices to come back up. This has resulted in market stagnation while the global economic situation is still vicarious."

The interesting thing is that homes on the Westside of Vancouver are dropping further in price as they were someone affected further due to Asian speculatory investment. You can see just how different the prices are here:

"People who would have purchased pricey homes in Vancouver before are now choosing condos, and apartment rentals. They are willing to gamble on prices dropping further."

When do you think we will see prices come back up?
"That's a very hard question to answer. The yield curve on projected interest trends is very flat, so no increase is anticipated in the near future. Interest rate trends has always been a good benchmark in forecasting market activity in the past, but that may not be true anymore because markets are behaving strangely. In the United States, the Dow broke a record by going past 14,000, yet jobless rates are still high. There is just nothing to substantiate the optimism that governments are trying to sell. When we start seeing real recovery in places such as the United States and Europe, then Canada will tend to ride along in the recovery."

"I think the old rule of supply and demand will dictate when real estate prices rise again. There just isn't the demand for the extremely pricey real estate for which Vancouver has been famous. People have other options and are willing to wait it out."

"I think the real estate markets in Vancouver have been extremely overpriced for a long time. They may not ever go back to the rates they were before. In fact, I hope they don't. It's too hard on the overall economic system."

Whether these experts have an accurate grip on the situation is yet to be seen. For the time being, all that remains to be done is to wait and see what happens.

( -- February 13, 2013)  Scottsdale, AZ -- When you consider the enormity in the absolute numbers of people that are Chinese and who follow the Lunar New Year, there is close to one third the population of the world involved.  Now coupled with those people and businesses that interface and rely upon this population, it is no wonder that business, markets, and commerce are wrestled to their knees over this 2 ½ week period of time.

Chinese restaurants all over know this fact all too well.  Their reservations list and bookings are bursting at the seams.  For Chinese people, the banquets and large family meals are an integral part of the celebration.  Abundance in food, wealth, and health are ingredients ingrained in the fabric of the cultural nucleus of the Chinese.

Chinese food in and of itself has its own significance in its color, texture, and composition.  Greens are always important as they are a sign of wealth with healthy attributes.  Additionally, many Chinese and Asians are Buddhists and adhere to a vegetarian diet.  The greens and other plant like foods are central to a Chinese New Year staple dish called Buddha’s Delight.

With such an obsession with food and family, the focus on anything other than this celebratory time is for naught. Trading markets certainly see a falloff in liquidity while gaming locations see an upsurge.  Gambling is the pulse of Chinese entertainment.  Close down a casino in Macau or Las Vegas on Chinese New Year and take off 40% of the annual profits.

The Chinese restaurants carry the cultural torch for relaying the traditions and the food specialties during this time.  Their preparation and presentations tell much of the stories and folktales that accompany these delicacies.  Fish and chicken is always served as they represent luck and abundance.  The head and tail of any animal served is always intact and for good reason.  The completion of life is demonstrated with a complete animal that is served on a platter for all to see and taste.  Often times, there are colorful chips and fruits that ornately decorate a plate which attracts good luck and tidings for the new year.

This period of time is also significant as a demarcation point for people to revamp and set their sights and goals for a healthy and prosperous beginning as the year turns another page.  It is certainly an opportunity for many inside and outside the Chinese culture to experience the depth and history of a heritage worthy of centuries and dynasties past.

Contact The Jade Palace Restaurant in Scottsdale, Arizona at: (480) 585-6630/ (480) 391-0607      for more in depth information about the Lunar New Year and delicious food to accompany your celebration.

( -- February 13, 2013) Atlanta, GA -- Whether it is through emails, TV commercials or adverts on the radio, there is constantly something about a new gadget that will help to tone the stomach and get rid of the flab. But Mike Whitfield, a bootcamp expert and bodyweight trainer from Atlanta, GA, disputes the claims. They don’t work and they can cause more injury and harm than the good that they could do. The solution? Whitfield has created the Bodyweight Torch program and the Stability Ball Plank is just one of the exercises. He’s also released a video to show people just how it is completed to make the most of your exercise.

Whitfield states that the Stability Ball Plank is a great ab exercise and will improve a person’s abs and core stability without having to do sit-ups and crunches all day long. Planks – and there are many different types of them – offer more benefit than the expensive gadgets you see on the TV on a daily basis.

The exercise requires no expensive equipment. All you need is a stability ball and these are available affordably from sports stores and local retailers. While the plank is good, using the stability ball will make it roughly 30% harder.

“I’ve suggested to my readers to first perform the regular plank exercise and master it before trying the advanced ab exercise,” Whitfield stated when releasing the video. It is important to brace the abs the whole time during this workout. Thousands of clients have found that this is one of the greatest ways to work the abdominal muscles.

You can download the Bodyweight Torch program for free for a limited time only. It offers a four-week training program with many different plank exercises. Download it from

About: Mike Whitfield is a boot camp workouts and bodyweight exercises expert.  He recently released the free workout program BodyweightTorch to celebrate his 3 year anniversary of losing 105 pounds with bodyweight exercises.  Recently he also released a bodyweight exercise video demonstrating the jump squat.

( -- February 14, 2013) Milton Keynes, Buckinghamshire, UK -- An increasing number of UK employers are now utilising legally drafted documents known as compromise agreements in redundancy situations to safely terminate contracts of employment.

There is a good reason for this, which we explain below. And equally, for the reasons we shall shortly explain, it is important for employees to understand their entitled on redundancy and how to identify if they have grounds to negotiate a better redundancy compromise agreement.

A compromise agreement is a specifically drafted legal contract or agreement that is designed to end a contract of employment between an employer and an employee.

The main purpose of the agreement is to bring to an end a contract of employment with an agreed financial package that is offered to the employee in exchange for which the employee promises not be bring any employment related claims against the employer. Once that agreement is signed, the employee cannot later go back to regnotiate or seek further compensation in an employment tribunal or court of law.

A compromise agreement on redundancy is the only legally binding agreement that an employer can safely rely on to ensure that they are not the unwitting recipient of an employment tribunal claim or a claim in the civil courts of law.

However, for compromise agreements to be legally binding and enforceable, the law prescribes certain conditions, the main condition being that an employee obtain independent legal advice.

Faced with the prospect of redundancy and the uncertainty of knowing how long it will take to find alternative employment, an employee ought to have some understanding of his or her entitlement on redundancy and whether there is room for negotiating a better redundancy deal.

As a starting point, all employees are entitled to notice of termination of employment, except in situations of gross misconduct in which case an immediate dismissal is permitted.

To determine the length of notice, and therefore pay that an employee is entitled to, there are two sources of reference.

The first point of reference is what the law or statute says an employee is entitled to.

And the second, is what an employee's individual contract states as notice period. The employee is entitled to whichever notice period is the greater of the two.

Statutory notice is calculated by reference to the number of years of service. The law says that an employee is entitled to one week's notice after working for more than one month but less than two years. Thereafter, an employee is entitled to 1 week's notice for every year worked. So two years of continuous employment equates to 2 weeks notice.

If an employee's contract gives a more generous period of notice, then this will apply in place of the statutory notice period.

In addition to notice, and perhaps pay in lieu of notice, an employee is also entitled to all other benefits received pursuant to the contract of employment up to the date of dismissal. For example, healthcare cover, car allowance, company car, bonus pay and so forth.

As with notice, to calculate redundancy pay, one must consider both the statutory position and also the employee's contractual rights.

If a company runs a redundancy scheme, more often than not this will be more generous than the prescribed statutory minimum redundancy that all UK employees are entitled to - assuming that the employer has served the qualifying period of two or more years of continuous employment with their employer.

Bear in mind also that contractual redundancy packages will usually already include statutory minimum redundancy pay. So any redundancy payments over and above the statutory minimum are considered "enhanced payments".

So, in order therefore to assess the correct amount of redundancy pay, one must first ascertain whether the employer has a redundancy program in place. If the employer does run such a scheme an employee would need to start here to calculate their redundancy entitlement.

To calculate the statutory minimum redundancy pay, three factors are taken into consideration. The age of the employee, the length of service of employment (with a maximum 20 years), and the employee's weekly pay up to a maximum of £450 (as at Feb 2013). For a fast and easy way of calculating statutory minimum redundancy pay, you can follow the link above.

What if you employer is only offering you the statutory minimum redundancy pay or a package that is only marginally above this? Under what circumstances can you negotiate better terms?

If an employee's contract of employment is being terminated "under a cloud" for example, there is an ongoing dispute between the employer and the employee, or where it is believed the employer is unlawfully terminating a contract of employment, in these circumstances, an employee is more likely to have more leverage to negotiate a better redundancy settlement within a redundancy compromise agreement than in cases of straightforward redundancy.

Ultimately, what you can negotiate very much depends on a number of factors such as your skills at negotiating, whether your employer is open to some flexibility on final pay, and other factors such as mentioned above that may give an employee more persuasion since an employer will also want to avoid potential claims in the future.

For specialist help and advice on a redundancy compromise agreement, you can find more information at the following web address, where you will also find a contact telephone number should you wish to speak with a specialist compromise agreement solicitor.

( —February 13, 2013) Tampa, FL—Where there is good food, music, and familiar faces that are happy to share in diverse backgrounds and happy times, Café Ole has emerged to fill that void in New Tampa’s Cross Creek’s newest and coolest destination for the locals to just kick back and enjoy.  What is it though that creates such a venue that attracts the regulars to come back over and over again?

The bar is a good place to start as seating in a cozy environment where regular patrons can almost be found in assigned seats.  The faces are happy, friendly, and ready to welcome and embrace a new entrant that cautiously sets foot inside to explore.  The place is cool because it is casual yet upscale with a warm surrounding.  The bar is dark yet bright where patrons can watch their favorite sporting event or just chit chat about the economy.

Café Ole’s wait staff is eclectic to the core.  Being a Spanish restaurant, there are plenty of Spanish speaking staff members that all come from different parts of Latin America while there are also many American born bar and wait staff.  The food fare is predominantly Spanish with crowd favorites like paella and chicken or tuna croquettes, but Caesar salad and sandwiches are equally popular and available.  The kitchen features special Serrano’s ham and Manchego and Cabrales cheese that they call “Tabla Ole”.  A Spanish restaurant would not be complete without a full Tapas menu of hot and cold dishes.  The full array of mussels, meats, and octopus fill out just some of the Tapas delicacies that line the menu.

Music and entertainment are beginning to fill the room with Flamenco dancers, live singers, and soon to come nightclub dancing with a full DJ in an adjacent room that is expanding the Café Ole scene.  With so much activity and delicious food and drink, is it no wonder that Café Ole has taken New Tampa’s Cross Creek area by storm?  For more detailed information about Café Ole, contact (813) 907-5242    or checkout their website at
